What does it mean to be a Child in Need of Assistance?

Parents can be served with a child in need of assistance action for a variety of reasons.

In can be due to problems with the parent such as neglect, substance abuse, physical abuse or sexual abuse. However, if can also be due to problems with the child such as substance abuse or mental health issues. Even if you are served with a Petition to adjudicate your child a Child in Need of Assistance, you still have rights. In order to adjudicate your child a Child in Need of Assistance, the State must prove whatever ground they have alleged. Further, even if you child is adjudicated, the State is required to provide reasonable efforts to reunite you with your child.
